Release and Waiver of Liability

This Release and Waiver of Liability (the “Release”) executed by (the “Volunteer”) in favor of Unexpected Blooms, Inc., a non-profit corporation, their directors, officers, employees, agents and affiliates (collectively, “UB”).

The Volunteer desires to work as a volunteer for UB and engage in the activities related to being a volunteer at UB (“Activities”), which may include pickup, processing and delivery of flowers, floral arrangements, and vases in the area served by UB.

The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:

Release and Waiver: The Volunteer does hereby waive, release and forever discharge and hold harmless UB and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that the Volunteer (or the Volunteer’s heirs or assigns) may have against UB, which arise ormay hereafter arise from Volunteer’s Activities with UB. Volunteer understands that this Release discharges UB from any liability or claim that the Volunteer may have against UB with respect to any bodily injury, personalinjury, illness, death, or property damage that may result from the Volunteer’s Activities with UB, whether caused by the negligence of UB or its officers, directors, employees, or agents or otherwise. Volunteer also understands that the scope of the Volunteer’s relationship with UB is limited to a volunteer position and that no compensation is expected in return for services provided by the Volunteer; that UB will not provide any benefits traditionally associated with employment to the Volunteer; and that the Volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of the Volunteer’s services to UB.

Medical Treatment: Volunteer does hereby release and forever discharge UB from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered by UB or any other provider in connection with the Volunteer’s Activities with UB.

Assumption of the Risk: Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases UB from all liability for injury, illness, death, or property damage resulting from the Activities.

Insurance: The Volunteer understands that UB does not carry or maintain health, medical, or disability insurance, and that UB does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance or medical expense reimbursement in the event of injury or illness, or damage to my property. Volunteer expressly waives any such claim for compensation or liability on the part of UB in the event of such injury or medical or property expenses incurred by me.

Photographic Release: Volunteer does hereby grant and convey unto UB all rights, title, and interest in any and all photographic images and video or audio recordings made by UB during the Volunteer’s Activities with UB, including, but not limited to, the right to use such images or recordings for the promotion of UB and any royalties, proceeds, or other benefits derived from such photographs or recordings.

Other: Volunteers shall not engage in political or religious activities while performing the Activities on behalf of UB.

Kansas Law: Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Kansas and that this Release shall be governed by and interpreted in accordance with the laws of the State of Kansas. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

I am of legal age and am freely signing this agreement. I have carefully read this agreement and fully understand its contents. I am aware that by signing this release of liability, I am giving up legal rights and remedies.
